1. Service Description

BookSmith is an AI-assisted book creation platform that helps users generate, edit, and export manuscripts. Our service is designed to streamline the book production process, but does not guarantee publishing success, bestseller status, or any specific commercial outcome. The quality, marketability, and reception of generated content depend on many factors outside our control.

2. Usage Rights and Content Ownership

You own all content generated through BookSmith using your account. BookSmith retains no rights to your books, manuscripts, outlines, or any other content you create on the platform. You are free to publish, license, sell, and monetize your generated content under your own name without restriction.

3. Content Restrictions

You agree not to use BookSmith to generate content that:

• Contains hate speech, promotes violence, or targets individuals or groups based on protected characteristics
• Is illegal or promotes illegal activities in any jurisdiction
• Violates third-party intellectual property rights, including copyright, trademarks, or trade secrets
• Contains sexually explicit material involving minors
• Is designed to deceive, defraud, or mislead others

4. Credit System

BookSmith operates on a credit-based system for content generation. Credits are consumed when you initiate a generation task. Once credits have been used to start a generation, they are non-refundable. Unused credits may be refunded within 30 days of purchase. Credit pricing and packages are subject to change, but changes will not affect credits already purchased.

5. Limitations of Liability

BookSmith is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the quality, accuracy, completeness, or reliability of AI-generated output. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to lost profits, lost data, or business interruption.

6. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms of service, engage in abusive behavior, or use the platform for prohibited purposes. We will make reasonable efforts to notify you before termination, except where immediate action is necessary to protect the platform or other users. You may also delete your account at any time through your account settings.

7. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or an in-app notification at least 30 days before they take effect. Your continued use of the service after changes become effective constitutes acceptance of the updated terms.

8. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of BookSmith shall be resolved in the courts of Delaware.
